Last week, a divided US Court of Appeals ruled 7-4 that the tariffs, enacted under the International Emergency Economic Powers Act exceeded Trump’s powers and were instead a “core Congressional responsibility”. The decision could force the government to return billions in collected tariffs, affecting both economic and foreign policy. Trump had argued the measures were necessary to address trade imbalances threatening US manufacturing and national security. While the appellate court ruled against him, it delayed enforcement giving the administration time to appeal to the Supreme Court.
