The American Beverage Association refutes the lawsuit’s claims, stating that California’s 71% recycling rate proves bottles are designed for reuse. Microplastics from disintegrated plastic waste harm marine life, affect soil, and have been found in body tissues, raising health concerns over potential links to diseases. The lawsuit requests court orders to halt misleading practices, restitution for consumers, and civil penalties up to $2,500 per violation. In 2020, Earth Island Institute sued Coca-Cola, PepsiCo, and other corporations in California, seeking cleanup damages for environmental plastic waste. New York previously filed a similar suit against PepsiCo, but it was dismissed, with a judge ruling no grounds to hold companies liable for public littering.
