Freeman and Moss were ultimately harassed by people who believed the conspiracy theories. On Aug. 30, U.S. District Court Judge Beryl Howell ruled that Giuliani is liable for defaming Freeman and Moss. Giuliani reportedly violated Judge Howell's orders to provide discovery to the plaintiffs, which resulted in a "default" judgement against the 79-year-old. He must pay "punitive" damages to the two election workers. "Just as taking shortcuts to win an election carries risks — even potential criminal liability — bypassing the discovery process carries serious sanctions.", Judge Beryl Howell, via ruling. Giuliani blames his inability to provide discovery on the fact that the FBI seized his devices in 2021, among other things. "This decision should be reversed, as Mayor Giuliani is wrongly accused of not preserving electronic evidence that was seized and held by the FBI.", Ted Goodman, a political advisor to Giuliani, via Politico.
