Judge Fernando Rodriguez, a Trump appointee, called the move “unlawful” and said the law was wrongly applied. The 1798 statute allows for deportations only during war or invasion. Trump had invoked it in March, claiming the Venezuelan Tren de Aragua gang was waging “irregular warfare” on the U.S., and deported dozens without court hearings. The judge ruled the U.S. is not facing an armed attack and said the president’s use of the law contradicts its original intent. This marks the first federal ruling to block Trump’s application of the Alien Enemies Act.
